Terms of Service

1. Who we are and what this covers

These Terms of Service ("Terms") are an agreement between you and Next Level Prospects, formerly Next Level Recruiting MN ("Next Level," "we," "us"). They cover the website, the app, player profiles, team locker rooms, the college and coach database, messaging, and every paid plan, team membership and recruiting service we offer (together, the "Service").

By creating an account, buying a plan, using a sign-up link, or using the Service, you agree to these Terms and to our Privacy & Player Data page. If you don't agree, don't use the Service.

2. No guarantee of offers, scholarships, roster spots or results

This is the most important part of these Terms. Please read it.

• We do not and cannot guarantee any scholarship, offer, roster spot, walk-on spot, admission, camp invite, visit, contact from a college coach, playing time, or any other recruiting result.
• Every decision about recruiting, offers, scholarships, aid and admission is made only by the colleges, their coaches and their admissions and financial aid offices. We have no control over those decisions.
• Our evaluations, "level projections," school matches (Strong / Possible / Reach), minimum GPA estimates, target lists and recommendations are opinions and estimates to help you plan. They are not promises, predictions you can rely on, or official statements from any school.
• Profile views, coach messages and leaderboard rankings show activity on the Service. They do not mean a coach will recruit, offer or admit an athlete.
• Results depend on the athlete's ability, film, academics, effort, character, timing, team needs and many other things outside our control. Past results of other athletes do not predict yours.
• You will not get a refund because an athlete did not receive an offer, a scholarship, or any recruiting result.

3. Eligibility, minors and parents

• Many athletes on the Service are under 18. If you are under 18, a parent or legal guardian must agree to these Terms and to any paid plan. Inside the app the athlete makes his own choices (his profile, what's public, his evaluations and emails); a parent who links a login can see and change the same settings. By letting a minor use the Service, the parent or guardian accepts these Terms on the minor's behalf and is responsible for the minor's use.
• You must be at least 13 years old to use the Service. We do not knowingly collect information from children under 13. If we learn an account belongs to someone under 13, we will delete it. Parents who believe this happened can contact Emiliodcisneros@icloud.com.
• A minor can't buy a paid plan alone. Paid plans must be bought, or approved, by a parent or guardian, or by a school or team buying a Team Package.
• Parents and guardians can see, change the sharing of, download, and delete their athlete's profile at any time.
• College coach accounts are for verified college and university athletics staff only. We review every coach account by hand and may deny or remove any account at our discretion.

4. Your account

• Give us true, current information and keep it up to date. One person per account; don't share your login.
• You are responsible for everything that happens under your account. Tell us right away at Emiliodcisneros@icloud.com if you think someone else is using it.
• We may suspend, limit or close an account that breaks these Terms, is fake, puts athletes at risk, or that we're required to close by law. If we close a paid account because you broke these Terms, you are not owed a refund.

5. Athlete profiles and the information you post

• You own your content: your photos, film, stats, bio and everything else you add. You give us a non-exclusive, royalty-free license to host, display, copy, format and share it as needed to run the Service, including on your public profile, your team's locker room, leaderboards, and in the emails to college coaches that you, or our staff for a Next Level package, build and send with the Service. This license ends when you delete the content or your account, except for copies already sent to coaches or kept in routine backups for a limited time.
• Everything you post must be true. Stats, testing numbers (40 time, vertical, etc.), height, weight, GPA, test scores, offers and awards must be accurate and honest. Numbers you enter yourself are shown as self-reported. Never post fake offers, someone else's film, or edited numbers. We may remove anything we believe is false and close accounts that post it.
• Only post photos and video you have the right to use. If a photographer, school or video service owns the content, make sure you're allowed to share it.
• Profiles in the free plan and app sign-ups are visible to verified college coaches by default so athletes can be discovered. You can turn your public profile off or choose what it shows at any time in the Sharing tab. GPA is never shown publicly without separate consent.

6. NCAA, NAIA, NJCAA and other rules

• Athletes, families and coaches are each responsible for following the rules of the NCAA, NAIA, NJCAA, CCCAA, their state high school league (such as the MSHSL) and their school, including rules about recruiting contact periods, amateurism, name-image-likeness, eligibility and academics.
• We are not affiliated with or endorsed by the NCAA, NAIA, NJCAA, any athletic conference, any state high school league or any college. Eligibility information on the Service is a general summary and may be out of date. Always confirm with the NCAA Eligibility Center, the NAIA Eligibility Center, and the school.
• College coaches using messaging are responsible for following the recruiting rules that apply to them, including permissible contact dates.

7. College and coach information

• College details, staff names, titles and contact information come from schools' own public websites and other public sources. Coaching staffs change often. We work to keep it current but do not guarantee it is complete, correct or up to date. Verify important details with the school.
• Coach contact information is provided only to help athletes and their recruiting coordinators reach out about recruiting. You may not copy, scrape, export, resell or publish the coach database, use it to spam, send bulk unsolicited messages unrelated to recruiting, or use it for any other business.
• College names and logos belong to their schools and are shown only to identify them. Showing them does not mean any school endorses or works with us.

8. Messaging and contact between coaches and athletes

• Messages from college coaches are sent to the athlete's recruiting team at Next Level first. Athletes on a paid plan or a Next Level package can read and reply to them; free profiles are told a coach is waiting.
• We do not verify or guarantee what anyone says in a message. Use good judgment. Never send money, personal financial information, or private photos to anyone you meet through the Service.
• Report anything inappropriate, threatening or suspicious to Emiliodcisneros@icloud.com right away. We may review messages to keep the Service safe.

9. Plans, team memberships and payments

• Free profile: build your profile at no cost. Paid features stay locked until you upgrade.
• Player Basic is a one-time payment for the features listed for Basic.
• Player Premium ($29.99 per month), All-American ($49.99 per month) and Five-Star ($119.99 per month) are subscriptions that renew automatically every month at the price shown when you sign up, until you cancel. By buying one, you agree that we and our payment processor may charge your payment method each month until you cancel. We show the price, the billing period and how to cancel before you pay, and send you a confirmation afterward.
• Launch pricing: payments made before November 10, 2026 get 25% off the first payment of any individual plan (Basic $15, Premium $22.49, All-American $37.49, Five-Star $89.99). Prices go back to normal and billing returns to the full regular price on November 10, 2026: every monthly renewal after the first payment is charged at the regular price shown above. The launch price is not combined with team discounts.
• For a subscription with no end date, we'll send you a reminder at least once a year that it is still active, with the price and how to cancel. Before any price increase or other material change to your subscription, we'll tell you in advance by email or in the app. The change applies only from your next billing period after the notice.
• If we ever offer a free trial longer than 30 days, we'll remind you 5 to 30 days before it ends, before you're charged.
• Team memberships (5 or more, discounted) and Next Level Team Packages give the buyer a number of player spots for a set period, plus a team locker room. Each spot can be used by one athlete. Team Packages include All-American unless the package says otherwise. Unused spots don't carry over after the paid period ends and can't be moved to another team. When the paid period ends, the athletes' paid features turn off unless the team renews or the athlete buys a plan.
• Next Level recruiting packages (such as the Evaluation, Starter, Next Level and Team Package) are services performed by Coach Smoot and our staff. The work described in each package is a list of services, not a promised outcome.
• Payments are handled by third-party processors (such as Stripe). We never see or store your full card number. The processor's terms also apply to your payment.
• Paid features may turn off if a payment fails, is reversed, or a subscription ends. Your profile and saved information stay unless you delete them.

10. Cancelling and refunds

• How to cancel: cancel Premium, All-American or Five-Star any time, online, with the Cancel auto-renewal button on your dashboard's plan card. You can also email Emiliodcisneros@icloud.com. You don't need to call us or give a reason. We confirm every cancellation.
• After you cancel, your plan stays active through the end of the month you already paid for, and then it won't renew. We don't give partial refunds for the rest of a month you've started.
• Basic, team memberships, Team Packages and recruiting package fees are non-refundable once the plan is turned on or the work has started (for example, an evaluation, profile, school list or outreach has begun).
• If you were charged by mistake or charged twice, contact Emiliodcisneros@icloud.com within 60 days and we'll fix it.
• Not getting an offer, scholarship, coach response or other recruiting result is not a reason for a refund (see Section 2).
• This section doesn't take away any refund or cancellation right you have under the law where you live.

11. Things you may not do

• Harass, threaten, bully, impersonate, or discriminate against anyone, or contact a minor in any way that is inappropriate or not about legitimate recruiting.
• Post false, misleading, sexual, violent, hateful or illegal content, or anyone else's private information.
• Create fake accounts, pretend to be a college coach, or use another person's account or sign-up link without permission.
• Scrape, copy, export or resell player profiles or the college and coach database, or use bots or automated tools on the Service.
• Try to get around plan limits, payments, verification or security, or interfere with the Service.
• Use the Service for anything that breaks the law or any athletic association's rules.

12. Team locker rooms

A team's locker room shows the public profiles of that team's athletes, plus the team's logo, banner and coach information. The coach or program that buys a team plan is responsible for having permission to use its logo and photos. A locker room is public only while the team's plan is paid; we may take down any logo or image if its owner objects.

13. Rankings, leaderboards, scores and badges

• Next Level Top Recruits rankings, the Next Level score, leaderboards, "Featured," "Rising," "Smoot's pick" and other badges come from our own formula and our staff's opinions. They use the information on the Service, much of it self-reported. They are not official rankings, evaluations or endorsements from any college, conference, league or ranking service.
• Only athletes with a public profile are ranked. An athlete or parent can leave the rankings at any time by turning the public profile off. "Featured" placement comes with the All-American plan and is labeled. It shows where a profile appears in lists. It is not a statement about the athlete's ability.
• We may change how rankings and scores work, and remove any athlete from them if their information looks false.

14. Emailing coaches and mass send

• When you email coaches with the Service, including mass send on Premium, All-American and Five-Star, you are the sender. We write the email; it goes out from your own email app or the email account you connect, with your name, and coaches' replies go to your email. We never send coach emails for you automatically. You are responsible for what you write. Every statement about the athlete has to be true.
• Only send recruiting emails about the athlete. No ads, chain messages, or anything unrelated to recruiting. Mass send is limited to a set number of schools per send and emails per month (shown on the Mass send page), and only to schools on the athlete's list. Stop emailing any coach who asks you to.
• We may pause sending for any account that gets spam complaints or breaks these rules.

15. Spotlights, testimonials and use of names and photos in our marketing

• We will only feature an athlete by name or photo in our ads, front page or social media (for example, an "athlete spotlight") with permission from the athlete and, for a minor, a parent or guardian. That permission can be withdrawn at any time by contacting Emiliodcisneros@icloud.com, and we'll take the feature down.
• If a featured athlete got anything from us for free or at a discount (such as a plan or Team Package spot), we'll say so where it matters. Claims about an athlete's ranking or results will be true and based on a source we can identify.

16. Copyright complaints

If you believe content on the Service infringes your copyright (for example, someone uploaded your photo or film without permission), email Emiliodcisneros@icloud.com with: your contact info, the work you own, the link to the content, a statement that you believe in good faith the use isn't authorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner. We'll review it and remove infringing content. Accounts that repeatedly post others' content may be closed.

17. Third-party sites and services

The Service links to and embeds content from other sites, such as Hudl, YouTube, MaxPreps, X, Instagram and college websites. We don't control them and aren't responsible for their content, availability or practices.

18. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't promise the Service will be uninterrupted, error-free or secure, or that any information on it is correct or complete.

19. Limitation of liability

To the fullest extent the law allows, Next Level Prospects, Coach Smoot, and our staff, partners and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost scholarship, offer, admission, opportunity, profits or data, arising from or related to the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim, or $100, whichever is greater.

Some places don't allow these limits, so parts of this section may not apply to you.

20. Indemnity

You agree to defend and cover us for claims, losses and costs (including reasonable attorney's fees) that come from content you post, your use of the Service, or your breaking these Terms or the law. If you're a minor, your parent or guardian agrees to this for you.

21. Deleting your account

You can delete your profile and account at any time from the Account page. Deleting removes your profile, film, stats and recruiting records from the Service. Copies already sent to coaches, and limited backups kept for security, may take time to clear or may not be recoverable by us.

22. Changes to the Service or these Terms

We may update the Service and these Terms. If we make a major change, we'll post the new date at the top of this page and, when it matters, tell you in the app or by email. Using the Service after a change means you accept the updated Terms.

23. Disputes and governing law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at Emiliodcisneros@icloud.com and try to resolve it informally for at least 30 days. Any legal action must be brought in the state or federal courts located in Hennepin County, Minnesota, and you and we consent to those courts. Either of us may bring a qualifying claim in small claims court.

24. Everything else

If any part of these Terms can't be enforced, the rest still applies. Our not enforcing a part right away isn't a waiver. You can't transfer your account or these Terms without our OK. These Terms, the Privacy page, and the description of any plan or package you buy are the whole agreement between you and us about the Service.
